1. Membership Structure

APEX Swim School operates on a monthly membership model. Enrollment secures a recurring spot in a scheduled class and continues until a withdrawal request is submitted.

2. Automatic Billing

• All accounts are enrolled in automatic monthly billing

• Payments are processed on the 11th day of each month

• Charges are applied to the payment method saved in your account (e.g., credit card, Visa Debit, Mastercard, or other authorized payment method)

• Membership billing continues automatically unless a withdrawal request is submitted in accordance with this policy

3. Payment Information

• Families are responsible for maintaining accurate and up-to-date payment information in their account at all times

• Expired or invalid payment methods must be updated before the billing date to avoid failed transactions

• By saving a payment method on file, families authorize APEX Swim School and its payment processor to use account updater services provided by financial institutions and card networks to update expired or replaced card information when available

• Families are responsible for reviewing their account information regularly and ensuring billing information remains valid

4. Credit Card Processing Fee

• To help offset credit card processing costs, a 2.4% fee will be applied to all transactions paid using Visa or Mastercard credit cards

• This fee does not apply to debit cards or other accepted forms of payment

• Applicable processing fees are considered part of the total authorized transaction amount

5. Failed Payments and Fees

If a payment is declined, returned, or fails for any reason:

• The balance remains outstanding and due immediately

• Any processing, NSF, PAD return, administrative, or late fees charged by the payment processor are the responsibility of the family

• Returned PAD (Pre-Authorized Debit) transactions may be subject to a $12.50 PAD Late Return Fee or other applicable fees charged by the payment provider

• Outstanding balances may result in suspension of participation until payment is completed

APEX Swim School reserves the right to:

• Reattempt payment using the payment method on file

• Suspend participation in classes until payment is successfully processed

• Restrict future registrations or participation

• Remove participants from class rosters for overdue accounts

6. Chargeback Policy

A chargeback occurs when a cardholder disputes a transaction through their credit card company or financial institution.

By registering for APEX Swim School programs, families acknowledge and agree that:

• Membership fees, recurring payments, processing fees, and other authorized charges are valid and authorized transactions

• Chargebacks submitted for legitimate and authorized charges may be formally disputed by APEX Swim School and/or its payment processor

If a chargeback notification is received:

• APEX Swim School and/or its payment processor may contact the account holder by email or text message regarding the dispute

• Families may be required to provide additional information or clarification within a limited response period

• APEX Swim School reserves the right to submit relevant records as evidence, including:

  • Registration agreements

  • Electronic policy acknowledgments

  • Attendance records

  • Billing history

  • Communication records

  • Signed waivers and online consents

Families are responsible for all chargeback fees, penalties, and administrative costs associated with disputed transactions, including a $25.00 chargeback fee charged by the payment processor.

Accounts associated with unresolved chargebacks may result in:

• Immediate suspension from programs

• Loss of reserved class spots

• Denial of future enrollment until all balances and fees are paid in full

7. Withdrawal Policy

• Written notice of withdrawal must be submitted before the 10th day of the month

• If notice is received after the 10th, the upcoming month’s fee will still be charged on the 11th

• Enrollment continues automatically unless a withdrawal request is received on time

• Withdrawal requests must be submitted in writing by email or through approved account communication methods

8. No Refund Policy

All payments, membership fees, and processing fees are final and non-refundable unless otherwise required by law.

No refunds will be issued for:

• Missed classes

• Partial attendance

• Late withdrawal requests

• Schedule conflicts

• Closures caused by weather, operational issues, or unforeseen events where a make-up class or credit is offered at the discretion of APEX Swim School

9. Account Standing

Accounts with outstanding balances may result in:

• Temporary suspension from classes

• Loss of reserved class spots

• Restriction from future enrollment or participation

Access to programs may resume once the account is brought into good standing.

10. Third-Party Payment Processing

• APEX Swim School uses third-party systems and payment processors (including Jackrabbit and related payment providers) for registration, billing, and payment processing

• By registering, families agree to the use of these systems and their applicable terms, communication methods, and security practices

• Payment information is processed and stored securely through PCI-compliant third-party payment providers

• APEX Swim School does not directly store full credit card information on its own servers

11. Electronic Communication Consent

By registering for programs, families consent to receive electronic communications from APEX Swim School and its service providers, including:

• Billing notices

• Payment reminders

• Failed payment notifications

• Chargeback notifications

• Operational announcements

• Program updates and policy communications

Families are responsible for maintaining accurate email and contact information and for monitoring their registered communication channels.

12. Policy Updates

APEX Swim School reserves the right to update this Payment & Membership Policy at any time. Updated versions will be posted on our website and become effective immediately upon posting.

Continued participation in programs after policy updates constitutes acceptance of the revised policy.

13. Electronic Agreement and Consent

By completing registration and selecting “I Agree” through our registration platform, families acknowledge and agree that:

• They have read and understood this Payment & Membership Policy

• Electronic acceptance of policies and agreements is legally binding and equivalent to a handwritten signature

• They authorize recurring payments in accordance with this policy
