Welcome to ​Apex Enrichment Academy. These Terms and Conditions govern your use of our website, services, and programs. By accessing or using our services, you agree to comply with these terms. If you do not agree, please refrain from using our services.

1. DEFINITIONS

  • "Company" refers to ​Apex Enrichment Academy, including its affiliates, partners, employees, and representatives.

  • "Services" include but are not limited to sports training, after-school programs, holiday camps, coaching, and educational services offered by ​Apex Enrichment Academy.

  • "User" refers to any person accessing or using our services, including parents, students, coaches, and school representatives.

  • "Website" refers to www.apexenrichment.com

2. ACCEPTANCE OF TERMS

By accessing our website or enrolling in our programs, you acknowledge that you have read, understood, and agreed to be bound by these terms. We reserve the right to update these terms at any time, and continued use of our services constitutes acceptance of the revised terms.

3. ELIGIBILITY

  • Individuals under 18 years of age must have parental or guardian consent to enroll in our programs.

  • By registering, you confirm that the information provided is accurate and truthful.

  • We reserve the right to refuse service to anyone for violating our terms or engaging in misconduct.

4. PROGRAM REGISTRATION AND PAYMENT

  • Registration is confirmed only after payment is received.

  • Payments must be made via the methods specified on our website or communicated via official channels.

  • Fees are non-refundable unless otherwise stated in our Refund & Cancellation Policy.

  • ​Apex Enrichment Academy reserves the right to cancel or reschedule programs due to unforeseen circumstances.

5. REFUND POLICY

​Apex Enrichment Academy follows a strict refund policy for programs offered in Halifax clubs, which includes:

  • Full Refund: If a participant withdraws at least 14 days before the start of the program, a full refund will be issued minus a processing fee of CAD 25.

  • Partial Refund (50%): If a participant withdraws between 7 to 13 days before the start of the program.

  • No Refund: If a participant withdraws less than 7 days before the start of the program or after the program has begun.

  • Program Cancellation by ​Apex Enrichment Academy: In the event of program cancellation due to low enrollment or unforeseen circumstances, participants will receive a full refund or credit for a future session.

6. MAKE-UP CLASS POLICY

We understand that absences may occur. Therefore, our make-up class policy is as follows:

  • Make-up classes are only offered for sessions canceled by ​Apex Enrichment Academy due to instructor absence or facility closure.

  • If a participant misses a class due to personal reasons (illness, travel, schedule conflict, etc.), no make-up session or refund will be provided.

  • Make-up classes must be scheduled within the same program term and are subject to availability.

  • For swimming programs, make-up sessions will only be allowed for medically excused absences (doctor’s note required).

  • Competitive teams or special training programs may have different make-up policies, which will be communicated separately.

7. ABSENCE POLICY

To maintain a structured training environment, we have an absence policy for all clubs in Halifax:

  • Participants are expected to attend all scheduled classes.

  • If a participant is absent for more than 2 consecutive weeks without prior notice, their enrollment may be forfeited without refund.

  • If a participant cannot attend a session, parents must notify ​Apex Enrichment Academy at least 24 hours in advance.

  • For team sports (Soccer, Basketball, Volleyball, etc.), excessive absences may impact playing time and participation in competitions.

  • For private lessons (Swimming, Tennis, Badminton, etc.), no-shows without prior notice will not be rescheduled.

8. CODE OF CONDUCT

All participants, parents, and staff are expected to maintain a respectful and positive environment.

  • Prohibited behavior includes, but is not limited to:

    • Harassment, discrimination, or bullying.

    • Physical or verbal abuse toward staff or participants.

    • Damage to company or third-party property.

  • Failure to comply may result in removal from the program without a refund.

9. LIABILITY WAIVER

  • ​Apex Enrichment Academy and its staff are not liable for injuries, accidents, or damages occurring during participation in our programs, unless due to proven gross negligence.

  • Parents/guardians acknowledge the risks associated with physical activities and accept responsibility for any injuries.

  • ​Apex Enrichment Academy is not responsible for lost or stolen belongings during sessions.

10. INTELLECTUAL PROPERTY

  • All content on our website, including text, images, logos, and course materials, is owned by ​Apex Enrichment Academy and protected under copyright law.

  • Users may not reproduce, distribute, or use any content without prior written consent from the company.

11. THIRD-PARTY SERVICES & LINKS

  • Our website may contain links to third-party websites.

  • ​Apex Enrichment Academy does not control, endorse, or assume liability for third-party content, services, or policies.

12. DATA PRIVACY & PROTECTION

  • We collect and store user information for registration and service improvement purposes.

  • Personal data is protected in compliance with applicable data protection laws.

  • Users can request to access, update, or delete their personal information by contacting us.

  • We do not sell or share personal data with third parties except as required by law.

13. FORCE MAJEURE

​Apex Enrichment Academy is not liable for service interruptions or cancellations due to circumstances beyond our control, including natural disasters, government restrictions, strikes, or technical failures.

14. TERMINATION OF SERVICE

We reserve the right to suspend or terminate a user’s access to our services if they violate these terms, engage in misconduct, or fail to comply with payment obligations.

15. DISPUTE RESOLUTION

  • In the event of a dispute, parties agree to attempt an informal resolution before pursuing legal action.

  • Any unresolved disputes shall be governed by the laws of Nova Scotia, Canada and settled in the courts of Halifax.

16. CHANGES TO TERMS & CONDITIONS

​Apex Enrichment Academy reserves the right to modify these terms at any time. Users are encouraged to review them periodically. Continued use of our services constitutes agreement to the latest version of the terms.
